This is an appeal from an order of the Itasca County District Court denying appellants petition for post-conviction relief. On June 7, 1974, appellant was convicted by a jury of the crime of simple robbery. He was sentenced on July 1, 1974, to an indeterminate term at the State Prison. On January 7, 1975, after the time for taking a direct appeal had expired, he petitioned for post-conviction relief. Although the post-conviction court concluded that appellant had been denied a fair trial, the petition was denied due to appellants failure to seek direct review of the conviction. The sole issue presented is whether post-conviction relief should have been granted. We reverse.
