Defendant appeals from a conviction of aggravated robbery committed in Hennepin County on January 17, 1965, for which he was sentenced to the custody of the commissioner of corrections for a term not to exceed 10 years. The evidence of defendants participation, with an accomplice, in the armed robbery of a Clark Oil and Refining Service Station at 2000 Portland Avenue, Minneapolis, on that date is so overwhelming as hardly to require recitation except as it bears on the two issues raised on this appeal:
