Wiser V. People

The defendant raised the juror misconduct issue, among other issues, in his appeal to the court of appeals. The court of appeals agreed with the defendant that the consultation of outside sources by the jurors was misconduct, but it rejected the defendant's invitation to presume that the juror misconduct was prejudicial.
