These appeals are from convictions for engaging in organized criminal activity by conspiring to commit the offense of unlawful delivery of a controlled substance, to-wit: marihuana of more than four ounces under the provisions of V.T.C.A., Penal Code, § 71.02(a)(5). The punishment assessed appellant Nichols was three (3) years imprisonment and a $600 fine. Appellant Dugans punishment was assessed at six (6) years imprisonment and a $600 fine.
